These Terms of Service ("Terms") govern your access to and use of klouthome.com (the "Site") and your purchase of products from Klout Home LLC ("KloutHome," "we," "us," "our"), a Wyoming, USA limited liability company. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to purchase. By ordering, you represent that you meet these requirements and that the information you provide is accurate.
2. Orders & Order Acceptance
Your order is an offer to buy. We may accept or decline any order, in whole or in part, for any lawful reason — including suspected fraud, pricing or product errors, payment issues, stock limitations, or shipping restrictions — even after you receive an order-confirmation email. If we cancel an order after you have paid, we will refund the affected amount to your original payment method.
3. Pricing, Currency & Payment
- Prices are displayed in your local currency where available and may vary by region/market, and we may change prices, products, and promotions at any time without notice.
- We make reasonable efforts to display accurate prices; in the event of an obvious error, we may cancel and refund the order.
- We accept prepaid payment only: credit/debit card, Shop Pay, Apple Pay, Google Pay, and PayPal. We do not offer cash on delivery. Full payment is required before an order is fulfilled, and you authorize us and our processors to charge your selected payment method.
4. Shipping, Delivery & DDP
Products ship worldwide from our international fulfillment center on a Delivered Duty Paid (DDP) basis, meaning applicable duties and import taxes are included in the price you pay at checkout — no surprise customs fees on delivery. Delivery timeframes shown are good-faith estimates, not guarantees. Full details, including processing and transit times and lost/delayed package procedures, are in our Shipping Policy, which forms part of these Terms.
5. Returns, Refunds & Warranty
Returns, refunds, the 100-Day Satisfaction Guarantee, and the 1-Year Limited Warranty are governed by our Refund & Return Policy, which forms part of these Terms. You must contact us for authorization before returning any item.
6. Product Descriptions, Images & Colors
We strive for accuracy, but we do not warrant that product descriptions, dimensions, images, or other content are complete, current, or error-free. Actual product colors may differ from how they appear on your screen due to monitor and device settings. Minor variations in handmade or natural-finish kitchenware are normal and are not defects.
7. Intellectual Property
All content on the Site — including the "KloutHome" name and logo, text, graphics, images, and product photography — is owned by or licensed to Klout Home LLC and is protected by intellectual-property laws. You may not copy, reproduce, or use it without our prior written permission.
8. Prohibited Uses
You agree not to use the Site or products: for any unlawful purpose; to infringe our or others' rights; to transmit malware; to scrape, hack, or disrupt the Site; to submit false information; or to resell our products without authorization.
9. Disclaimer of Warranties
EXCEPT FOR THE EXPRESS 1-YEAR LIMITED WARRANTY STATED IN OUR REFUND & RETURN POLICY, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND KLOUT HOME LLC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you, and nothing here excludes liability that cannot be excluded by law.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KLOUT HOME LLC AND ITS MEMBERS, MANAGERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR PRODUCTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO AN ORDER OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law (including mandatory consumer-protection rights).
11. Indemnification
You agree to indemnify and hold harmless Klout Home LLC and its members, managers, and affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or products.
12. Governing Law
These Terms and any dispute arising from them are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country or state of residence apply.
13. Dispute Resolution; Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
We want to resolve concerns informally first: please contact support@klouthome.com before initiating any formal dispute.
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or your purchase that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at www.adr.org), and not in court, except as stated below. The arbitration will be governed by the Federal Arbitration Act. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver: You and KloutHome agree that claims may be brought only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall be severed and proceed in court.
Venue: Where AAA Consumer Arbitration Rules require an in-person hearing, it will take place in the consumer's home county or judicial district; otherwise, the arbitration may be conducted by telephone, videoconference, or written submission. Either party may (a) bring an individual claim in small claims court if it qualifies, and (b) seek injunctive or equitable relief in court to protect intellectual property.
Opt-out: You may opt out of this arbitration agreement by emailing support@klouthome.com within 30 days of your first purchase, stating your name, order number, and intent to opt out. Mandatory consumer-protection laws of your country (e.g., EU/UK/Australia) may give you the right to bring proceedings in your local courts; nothing here removes those rights where they apply.
14. Modifications to the Service & Terms
We may modify or discontinue the Site or any product at any time. We may update these Terms; the "Last updated" date reflects the current version, and your continued use after changes constitutes acceptance.
15. Severability & Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with our Refund & Return Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and Klout Home LLC.
